“Lack of Proof”: Spanish Court Puts Aside Shakira’s Tax Fraud Case

In July, prosecutors initiated the case, alleging that she utilized a network of enterprises, with some situated in tax havens, to defraud the tax authorities of 6.6 million euros ($7.09 million) in 2018.

Barcelona: A Spanish court declared on Thursday that it has closed an investigation into another alleged tax fraud involving Colombian pop star Shakira, thereby concluding her legal issues in the country where she previously resided.

The prosecutors initiated the case in July, alleging that she utilized a network of companies, some of which were located in tax havens, to evade payment of 6.6 million euros ($7.09 million) in taxes in 2018, including interest and adjustments. A month later, the renowned singer, often dubbed the “Queen of Latin Pop,” settled the debt by paying 6.6 million euros.

However, on Wednesday, prosecutors recommended that the investigation be terminated due to “insufficient evidence,” a suggestion which the court overseeing the case endorsed. While acknowledging “irregularities” in Shakira’s 2018 tax return, the court emphasized that these irregularities did not amount to a criminal offense against the tax authorities and concluded that Shakira did not have the intention to defraud them.

In a separate legal matter, Shakira reached a last-minute agreement with prosecutors in November, on the day her trial was set to commence, regarding another tax fraud allegation concerning her earnings from 2012 to 2014.

In that instance, prosecutors had sought a prison term exceeding eight years for the singer, accusing her of defrauding the tax authorities of 14.5 million euros. The case primarily revolved around determining the duration of her residency in Spain.

Shakira refuted the accusations, stating that she only relocated to Spain permanently in 2015. Prosecutors disclosed that by the time the trial commenced, Shakira had already paid 17.45 million euros to settle her outstanding tax liabilities.
